Amicus Brief Challenging Executive Order on Bequest Citizenship
On May 13, 2025, HRP Supervisor Teacher Gerald L. Neuman, together with Professors Kristin Collins and Rachel Rosenbloom, sent an amicus short to USA Court of Appeals for the 4th Circuit in an instance testing the legitimacy of President Trump’s Executive Order No. 14, 160 In the short, they argue that the Executive Order, which professes to deny birthright citizenship to children born in the USA lacking an U.S. citizen or authorized long-term resident moms and dad, not only disputes with the constitution yet goes against the Migration and Race Act (INA).
Making use of historic precedent and legal background, the three professionals of U.S. citizenship and immigration regulation highlight that the traditional broad analysis of territorial bequest citizenship, guaranteed in the Fourteenth Change, was deliberately codified in the 1940 Nationality Act and in Area 301 (a) of the 1952 INA, 8 USC area 1401 The experts wrap up that the INA offers a clear, independent legal ground to rule the Exec Order illegal.
